1. PURPOSE OF THE PRIVACY POLICY
1.1. This Privacy Policy establishes the conditions and purposes of the processing of Personal Data of Website Users.
1.2. Every User, by using the Website and providing their Personal Data, agrees that these Data will be processed in accordance with the procedure specified in this Privacy Policy.
1.3. Copying any information contained in this Privacy Policy without the consent of the Website Data Controller is strictly prohibited.
2. CONCEPTS USED
2.1. The following concepts are used in this Privacy Policy, which mean:
“Personal Data” or “Data” means any information about the User whose identity is established or whose identity can be directly or indirectly identified (data subject).
“Data Processing” means any operation or set of operations performed on Personal Data or sets of Personal Data, whether or not by automated means, such as Data collection, recording, sorting, systematization, storage, etc.
“Data Controller” is UAB “Foto Bitės”, legal entity code 302758954, registered office at Aguonų str. 12, Vilnius, LT03213, Republic of Lithuania.
“Website” is the website managed by the Data Controller, the address of which is https://www.fotobites.lt.
“Privacy Policy” is this privacy policy, which sets out the basic rules for the Data Controller's collection, accumulation, processing and storage of Personal Data, applicable to Users using the Website.
“Regulation” means Regulation 2016/679, which entered into force in the European Union on May 25, 2018, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
“Cookies” are small text documents containing a unique identification number that is transferred from the Website to the User's computer hard drive so that the Data Controller can distinguish the User's computer and see its activity on the Internet.
“User” is a natural person who has visited the Data Controller's Website and provided their Personal Data on it.
3. PROCESSED PERSONAL DATA
3.1. In order to use the services, the User must provide the Data Controller with their name, surname, email address, and in certain cases, telephone number and address.
3.2. Cookies about the User's browsing on the Website are also collected. The User can withdraw their Consent to the use of Cookies at any time. The User can do this by changing their browser settings so that Cookies are no longer stored. The instructions vary depending on the type of browser used by the User. 4. PURPOSES OF PERSONAL DATA PROCESSING
4.1. The Personal Data provided by Users is processed for the following purposes:
4.1.1. For the purpose of providing services. The Data Controller collects and uses Users' personal data to provide the services specified on the Website.
4.1.2. For communication purposes. So that the Data Controller can contact and answer the User's questions or requests.
5. DISCLOSURE OF PERSONAL DATA
5.1. The Data Controller ensures that Users' Personal Data will not be sold, provided or otherwise transferred to third parties without a legal basis, nor used for purposes other than those for which they were collected.
5.2. The Data Controller may transfer the User's Personal Data to third parties only:
5.2.1. in cases established by law and when it is necessary to implement the purposes of this Privacy Policy;
5.2.2. if separate consent of the User has been obtained for this Data transfer;
5.2.3. when it is necessary for the Data Controller to fulfill the contract concluded with the User and properly provide services;
5.2.5. in other cases provided for in the Regulation and the legal acts of the Republic of Lithuania.
6. DATA STORAGE TERMS
6.1. The Data Controller stores Users' Personal Data for the period specified in the applicable laws and other legal acts of the Republic of Lithuania, and in this Privacy Policy, but no longer than is necessary to achieve the Data Processing purposes of this Privacy Policy.
6.2. If the User submits a request to receive a personal offer or sends a personal message and provides their Personal Data, the Data Controller undertakes to store it for no longer than 5 (five) years from the User's last contact with the Data Controller, unless separate consent has been received from the User to store the Data for a longer period.
7. USER RIGHTS
7.1. Website Users have the following rights:
7.1.1. to know what Personal Data is being processed and for what purpose;
7.1.2. to access their Personal Data and download it in an easily readable format to their computer;
7.1.3. to demand that Personal Data be corrected or supplemented if it is inaccurate or no longer relevant;
7.1.4. to demand that Personal Data be deleted;
7.1.5. to demand that the Data Controller restrict the processing of the User's Personal Data;
7.1.6. to demand that the Data be transferred to another data controller;
7.1.7. to file a complaint with the State Data Protection Inspectorate for illegal processing of Personal Data or Data breach;
7.1.8. to object to the processing of Personal Data when these Data are processed or intended to be processed for direct marketing purposes.
7.2. The User has the right to submit any requests or instructions related to the processing of the User's Personal Data to the Data Controller in writing using the contact details (email) specified in this Privacy Policy.
7.4. Upon receipt of such a request or instruction, the Data Controller shall provide an answer and take the actions specified in the request or refuse to take them, stating the reasons for the refusal, no later than 30 (thirty) days from the date of the request.
7.5. The Data Controller reserves the right not to satisfy User requests, except for requests to refuse to receive direct marketing offers and to apply to a non-judicial dispute resolution institution, when it is necessary to ensure: (i) the performance of legal obligations imposed on the Data Controller; (ii) public order or prevention of criminal offenses; (iii) protection of the rights and freedoms of users or other persons; or (iv) in other cases specified in Article 23(1) of the Regulation. In any case, after refusing to fulfill User requests, the Data Controller clearly indicates the reasons for such refusal.
7.6. If the User notices illegal processing of their Data or a dispute arises with the Data Controller, they have the right to contact the non-judicial dispute resolution institution in Lithuania - the State Data Protection Inspectorate at any time, in accordance with the procedure specified on its website.
